Intellectual Property & Trademark

Protecting your name, your brand, and the intellectual property behind your business.

Your name, your brand, and the intellectual property behind your business can be among the most valuable assets you build. Pacific Street helps companies choose and clear names, register and maintain trademarks in the U.S. and abroad, enforce their rights, and establish clear ownership of the IP they create. Our trademark attorneys focus on federal trademark practice before the USPTO and the Trademark Trial and Appeal Board, as well as domain-name disputes, with flat-fee pricing for common needs.

What we do

Portfolio Management, Monitoring & International Protection

Trademark audits, brand monitoring, maintenance filings and renewals, and international protection through Madrid Protocol and national filings.

Trademark & Domain-Name Disputes

Sending and responding to cease-and-desist letters, TTAB oppositions and cancellations, WIPO domain-name disputes, and infringement litigation when necessary.

IP Ownership, Licensing & Commercialization

Founder, employee, and contractor IP assignments, confidentiality protections, licenses, and technology agreements governing the ownership and use of intellectual property.

IP in Financings, M&A & Strategic Transactions

IP diligence and transaction support, including chain of ownership, licensing restrictions, and other issues that affect the value or transferability of a company’s IP.

Brand Protection

Frequently asked questions

When should we start thinking about trademarks, and when should we file?

From the beginning. Names and brands become expensive to change once you have customers, a website, and investors. You can often file based on an intent to use a mark before launch, which locks in an earlier priority date. We help decide what to file, when, and which goods and services to cover.

How do I know if a company or product name is available?

An available domain or a clean internet search doesn’t mean a name is clear. We run and evaluate trademark searches covering federal registrations, applications, and other relevant uses. Then we help you weigh the practical risk before you invest in the name.

How much does trademark work cost?

Common trademark work is flat-fee, including searches and clearance, applications, audits, and renewals, so you know the cost before work begins. For companies with recurring needs, we can structure an ongoing program around the portfolio.

Can you manage our trademark portfolio as we grow?

Yes. We audit your names, brands, registrations, and applications to find gaps and upcoming deadlines. Then we manage the portfolio, including new applications, Office Actions, monitoring for conflicting marks, maintenance filings and renewals, and international protection as you enter new markets.

We’ve been using our company name for years, but it isn’t registered. Do we have any trademark rights?

Potentially, but with limitations. In the U.S., using a name to identify your goods or services can establish “common-law” trademark rights even without registration. Those rights are generally limited to the geographic markets where you operate and can be harder to establish and enforce. Federal registration provides broader protection, including presumptive nationwide rights (subject to certain prior users), a legal presumption of ownership, and the right to use the ® symbol. We help businesses assess their existing rights, identify potential conflicts, and secure federal trademark protection where possible.

Someone is using our name, or sent us a cease-and-desist letter. What should we do?

Don’t act until you understand your position. Receiving a demand letter doesn’t necessarily mean you have to stop, and not every overlapping use is worth fighting. We assess both sides’ rights, the strength of the claims, and the business stakes. Then we respond, negotiate, or enforce, including through TTAB proceedings, domain-name disputes, and litigation if needed.

How do we make sure the company owns the IP its founders, employees, and contractors create?

We review founder arrangements, employment and contractor agreements, IP assignments, and licenses to confirm what the company owns and close any gaps. A clean chain of ownership matters most when you raise capital, license your technology, or sell the company.

We’re raising money or preparing to sell. What IP issues should we address?

Investors and buyers will look at whether the company owns its core IP, whether everyone who built it assigned their rights, whether key trademarks are protected, and whether licenses restrict use or transfer. We review these issues before diligence and work with our corporate team so problems are resolved in advance rather than discovered by the buyer.
